Terms of Service

These Terms of Service apply to your access to and use of the Dishcoverie website, public pages, demo links, Foodie Pro early-access application flow, and any related services, features, forms, or content made available by Dishcoverie from time to time.

By accessing or using Dishcoverie, submitting a Foodie Pro application, or submitting content to Dishcoverie, you agree to these Terms. If you do not agree, do not use Dishcoverie or submit content.

Dishcoverie is operated from Ontario, Canada. Dishcoverie may be accessed by users in Canada, the United States, and elsewhere in North America, but not all features, cities, or programs are available in all locations.

You may use the public Dishcoverie website to learn about Dishcoverie, explore available public city and category pages, watch demos, and submit a Foodie Pro early-access application where available.

You agree that you will not misuse Dishcoverie, interfere with its operation, attempt to gain unauthorized access to any system or data, scrape or harvest data except as permitted by law, submit spam, impersonate another person or business, misrepresent your affiliation with any person or business, or provide false, misleading, infringing, unlawful, harmful, or abusive information.

You are responsible for all information and content you submit and for ensuring that your use of Dishcoverie complies with applicable laws and these Terms.

Submitting a Foodie Pro application does not guarantee approval, app access, paid opportunities, creator status, verification, promotion, public placement, or any particular visibility in Dishcoverie.

Dishcoverie may approve, waitlist, reject, remove, or stop accepting applications at its discretion, including where an application appears inaccurate, abusive, spammy, duplicative, misleading, or not aligned with the Foodie Pro program.

Requested creator handles are reviewed and may be reserved only after approval. A requested handle is not guaranteed until Dishcoverie confirms it has been approved and reserved. Dishcoverie may refuse, cancel, reassign, or require changes to a handle where necessary to prevent impersonation, infringement, confusion, abuse, or platform integrity issues.

Dishcoverie may allow users, applicants, creators, restaurants, or other participants to submit, upload, post, link, provide, or otherwise make available photos, images, videos, links, reviews, ratings, comments, recommendations, profile information, social handles, application information, restaurant or dish information, and other materials (collectively, "User Content").

You retain any ownership rights you may have in your User Content. Dishcoverie does not claim ownership of your User Content merely because you submit it.

You are solely responsible for your User Content and the consequences of submitting it. Dishcoverie has no obligation to publish, maintain, monitor, or continue displaying any User Content and may review, moderate, reject, remove, hide, edit for formatting, or disable access to User Content at any time, with or without notice, where permitted by law.

By submitting User Content, you represent and warrant that you own the User Content or have all rights, licences, permissions, releases, and consents necessary to submit it to Dishcoverie and to grant the licence described in these Terms.

You represent and warrant that your User Content does not infringe, misappropriate, or violate any copyright, trademark, moral right, publicity right, privacy right, confidential information right, contract right, platform rule, or other right of any person or entity.

You represent and warrant that your User Content is truthful to the best of your knowledge, is not misleading, does not falsely imply sponsorship or endorsement, and does not contain unlawful, defamatory, harassing, hateful, obscene, abusive, invasive, exploitative, or otherwise objectionable material.

If your User Content includes identifiable people, private property, copyrighted works, restaurant branding, music, video, or other third-party material, you are responsible for obtaining any permissions required before submitting it.

By submitting User Content to Dishcoverie, you grant Dishcoverie a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable, transferable, irrevocable licence to host, store, cache, reproduce, publish, display, perform, transmit, distribute, make available, adapt, crop, resize, reformat, edit for technical or presentation purposes, create derivative works from, and otherwise use your User Content in connection with operating, providing, improving, developing, promoting, marketing, and advertising Dishcoverie and related products, services, websites, apps, social channels, creator programs, city launches, restaurant discovery surfaces, and promotional materials.

This licence includes the right for Dishcoverie to use User Content in public website pages, app screens, Hype Lists, category pages, city pages, dish pages, creator/profile surfaces, social media posts, paid or unpaid advertisements, press materials, investor or partner materials, demo materials, and other marketing or promotional placements, whether online or offline, without further notice, approval, or compensation to you, except where prohibited by applicable law.

You also grant Dishcoverie the right to use your username, display name, profile information, creator status, badges, attribution, caption, rating, review, recommendation, and other related metadata in connection with the display, promotion, advertising, and use of your User Content.

You waive, and agree not to assert, any moral rights or similar rights you may have in User Content against Dishcoverie or its service providers, partners, licensees, successors, or assigns, to the extent permitted by applicable law.

Dishcoverie may moderate User Content to protect users, public trust, data quality, brand safety, intellectual property rights, and leaderboard integrity. Moderation decisions may be manual, automated, or a combination of both.

Dishcoverie may remove or restrict User Content that appears to violate these Terms, applicable law, third-party rights, community standards, platform integrity rules, or Dishcoverie's product standards.

If you believe content on Dishcoverie infringes your rights, email admin@dishcoverie.com with enough information for us to review the issue, including the relevant URL or content location, a description of the claimed rights, your contact information, and a statement explaining why you believe the content is unauthorized.

Dishcoverie is launching city by city. Some city and category pages may have limited public content while local coverage grows.

Public rankings, Hype Lists, ratings, recommendations, discovery surfaces, restaurant information, map links, pricing, photos, videos, creator content, comments, and other public information are provided for general informational and discovery purposes only and may be incomplete, inaccurate, unavailable, outdated, subjective, or change over time.

Ratings, reviews, rankings, recommendations, comments, photos, videos, creator content, and other User Content reflect the opinions, experiences, preferences, and submissions of individual users or creators. They do not necessarily reflect the views, opinions, endorsements, recommendations, or statements of Dishcoverie. Dishcoverie does not verify every user rating, review, ranking, recommendation, claim, photo, video, price, menu item, restaurant detail, or creator statement, and is not responsible for the accuracy, completeness, reliability, legality, or usefulness of User Content.

Dishcoverie does not guarantee the accuracy, completeness, legality, safety, quality, availability, pricing, ingredients, allergens, location details, business hours, menu availability, or suitability of any restaurant, dish, drink, creator content, User Content, or third-party information.

Dishcoverie may link to, embed, reference, or interoperate with third-party services such as Instagram, YouTube, Google Maps, app stores, restaurants, creator platforms, payment processors, hosting providers, analytics providers, or other external websites and services.

Dishcoverie is not responsible for third-party content, policies, practices, availability, security, errors, fees, or services. Your use of third-party services is governed by the terms and policies of those third parties.

Dishcoverie, including its name, logos, branding, product concepts, website content, page design, software, features, copy, visual assets, badges, layouts, trade dress, and related materials, is owned by Dishcoverie or its applicable rights holders and is protected by intellectual property and other laws.

Except as expressly permitted by Dishcoverie in writing, you may not copy, reproduce, modify, scrape, reverse engineer, sell, rent, sublicense, publicly display, distribute, or reuse Dishcoverie materials in a way that misleads users, suggests endorsement, competes unfairly, or violates applicable law.

Dishcoverie is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, Dishcoverie disclaims all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, reliability, security, or uninterrupted operation.

Dishcoverie does not warrant that the website, app, public pages, application flow, data, rankings, recommendations, creator features, or any related service will be error-free, secure, available, complete, current, or free from harmful components.

Dishcoverie is operated by Silarche Inc., an Ontario corporation. References to "Dishcoverie," "we," "us," and "our" in these Terms mean the Dishcoverie services operated by Silarche Inc.

To the fullest extent permitted by applicable law, Dishcoverie and its owners, directors, officers, employees, contractors, service providers, partners, licensors, successors, and assigns will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, or for any loss of profits, revenue, goodwill, data, content, business opportunity, or reputation, arising out of or related to Dishcoverie, these Terms, third-party services, or User Content, even if advised of the possibility of such damages.

To the fullest extent permitted by applicable law, Dishcoverie's total aggregate liability for all claims arising out of or related to Dishcoverie or these Terms will be limited to the greater of CAD $100 or the amount you paid directly to Dishcoverie for the service giving rise to the claim in the twelve months before the claim arose. Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Dishcoverie and its owners, directors, officers, employees, contractors, service providers, partners, licensors, successors, and assigns from and against any claims, demands, actions, proceedings, losses, liabilities, damages, judgments, penalties, fines, costs, and expenses, including reasonable legal fees, arising out of or related to your use of Dishcoverie, your User Content, your breach of these Terms, your violation of applicable law, your violation of third-party rights, or your misrepresentation of ownership, permissions, affiliation, identity, or authority.

Dishcoverie may modify, suspend, discontinue, restrict, or remove any part of the website, app, public pages, Foodie Pro program, creator features, demos, application flow, city coverage, or related services at any time, with or without notice, where permitted by law.

Dishcoverie may update these Terms from time to time. The updated version will be posted on this page with a revised date. Your continued use of Dishcoverie after updated Terms are posted means you accept the updated Terms, except where additional notice or consent is required by applicable law.

These Terms and any dispute arising out of or related to Dishcoverie are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law rules, except where mandatory consumer protection or other mandatory local laws require otherwise.

Subject to any mandatory rights you may have under applicable law, you agree that the courts located in Ontario, Canada will have exclusive jurisdiction over disputes arising out of or related to Dishcoverie or these Terms.
